These Terms & Conditions ("Terms") govern your access to and use of idumhitum.lk ("Website", "Platform", "we", "our", "us"). By accessing or using the Website, you acknowledge that you have read, understood and agreed to be bound by these Terms. If you do not agree with any provision of these Terms & Conditions, you must discontinue access to and use of the Website.

1. Nature of the Service

idumhitum.lk is an open online venue for advertisers to post property-related listings across Sri Lanka, including sales, rentals, and real estate services. We:

• Do not participate in the content of advertisements
• Do not verify the quality, legality, or accuracy of listings
• Do not mediate transactions between buyers and sellers
• Do not guarantee any advertiser's services or claims

All interactions, negotiations, payments, inspections, and agreements occur directly between the advertiser and the interested party. We are not a real estate broker, estate agent, auctioneer, representative or party to any transaction.

Once a user contacts an advertiser via phone or email, idumhitum.lk is no longer involved in the communication or transaction.

2. User & Advertiser Responsibilities

Users and advertisers must ensure that:

• All Content, including property descriptions, images, videos, documents and other materials submitted to the Website, is accurate, authentic, lawful and truthful.
• They own the property being advertised or have the lawful authority and all necessary rights and permissions to publish the listing and its Content.
• All documents uploaded are genuine, valid and lawfully obtained.
• They do not submit false, misleading, manipulated, AI-generated, digitally altered or otherwise fabricated content that misrepresents the property, its ownership, legal status, condition or any material fact.
• They do not impersonate any person or entity or submit fake, fraudulent, duplicate or bogus property listings.
• They comply with all applicable laws and regulations of Sri Lanka.
• They use the Website solely for lawful purposes and in accordance with these Terms.

Advertisers are solely responsible for verifying property ownership, authenticity, and legality before posting.

If any Content or listing is found or reasonably suspected to be false, fraudulent, misleading, inaccurate, manipulated, unlawful or otherwise in breach of these Terms, idumhitum.lk reserves the right at its sole discretion and without prior notice or assigning any reason to:

• Suspend, edit, refuse publication of, remove or permanently delete the listing.
• Suspend or permanently ban the User or Advertiser from accessing or using the Website.
• Preserve relevant records and cooperate with law enforcement or other competent authorities where required by law.
• Provide user information to affected parties or law enforcement authorities where permitted or required by applicable law.

3. Content & Copyright

By submitting any Content to idumhitum.lk, the Advertiser grants idumhitum.lk a worldwide, royalty-free, transferable, sublicensable and non-exclusive licence to solely for the purpose of operating, maintaining, promoting, improving and providing the Website and its related services:

• Use the Content;
• Reproduce the Content;
• Modify and adapt the Content;
• Publish and translate the Content;
• Create derivative works from the Content;
• Distribute the Content and
• Display the Content across the Website, any media or partner platforms.

The Advertiser represents and warrants that:

• They own or have obtained all necessary rights, licences, permissions and consents to upload the Content; and
• They have the authority to grant the above licence to idumhitum.lk.

All website design elements, branding, logos, trademarks, software, databases, text, graphics, layouts and other proprietary features of idumhitum.lk are protected by applicable intellectual property laws. Except with the prior written consent of idumhitum.lk, no part of the Website or its content may be copied, reproduced, modified, stored, republished, transmitted, distributed or otherwise exploited for any commercial or public purpose.

4. Watermarks & Image Rules

Images uploaded to idumhitum.lk may be automatically watermarked to prevent unauthorized reuse.

We reserve the right to:

• Edit listing titles for clarity
• Reject or remove irrelevant, inappropriate, or rule-violating images
• Remove Content that breaches legal or ethical standards

5. Listing Moderation

idumhitum.lk may, at its sole discretion:

• Refuse, delete, or remove any listing
• Remove listings that violate these Terms
• Remove listings containing inappropriate language, spam, or misleading information

We are not obligated to publish any listing.

6. Disputes Between Buyers & Sellers

Any dispute arising from:

• Property reservations
• Payments
• Inspections
• Misrepresentation
• Service quality
• Property condition

is strictly between the buyer and seller.

idumhitum.lk:

• Does not mediate disputes
• Cannot be held liable for losses, damages, or wrongdoing
• Is not responsible for the outcome of any transaction

7. Cooperation with Authorities

If Content or user activity violates Sri Lankan law, idumhitum.lk may:

• Share user information with authorities
• Provide IP addresses or account details
• Assist investigations

This includes cases involving fraud, impersonation, illegal property sales, or disputes.

8. Privacy & Data Collection

By using idumhitum.lk, users consent to the collection and use of their information for:

• Platform operation
• Technical support
• Marketing and research
• Service improvement
• Fraud prevention

We may share information with affiliated companies or service providers as needed. Personal information shall be processed in accordance with the Personal Data Protection Act, No. 9 of 2022, where applicable. Full details are provided in our Privacy Policy.

9. Cookies

Users must provide a valid email address to post listings. Email addresses are not publicly displayed. Other users may contact advertisers through the platform's messaging or email relay system.

Users are responsible for ensuring that their registered email address is accurate and active. Any notices, updates, or communications sent by idumhitum.lk to the registered email address will be considered received by the User.

11. Site Availability

idumhitum.lk does not guarantee:

• Continuous access
• Error-free operation
• Uninterrupted service
• Protection against data loss
• Correction of defects

The Website may contain technical inaccuracies or typographical errors. We are not responsible for keeping information updated.

12. Force Majeure

idumhitum.lk shall not be liable for any delay, interruption, suspension or failure to provide the Website or any services where such failure is caused by events beyond our reasonable control, including but not limited to:

• Internet service failures, network interruptions or telecommunications failures;
• Hosting, server or third-party service provider failures;
• Cyber-attacks, security incidents or technical failures;
• Power failures or infrastructure disruptions;
• Government actions, regulatory restrictions or changes in law;
• Natural disasters, pandemics, strikes or other events beyond our reasonable control.

During any such event, idumhitum.lk may suspend, restrict or modify the operation of the Website or any service without liability. We will take reasonable steps to restore the Website and services as soon as reasonably practicable.

14. Paid Services

• Promotional boosts
• Membership packages
• Category-specific paid ads

Fees are non-refundable unless otherwise stated. Payment for featured listings does not guarantee the sale, lease or enquiry volume of any property.

15. Memberships & Shops

For membership packages, idumhitum.lk may create a dedicated "Shop" page for advertisers. We reserve the right to:

• Manage Shop content
• Remove or edit content that violates these Terms
• Decline publication of inappropriate material

idumhitum.lk would also reserve the right to terminate memberships without refund where the Terms are breached.

16. Disclaimer and Limitation of Liability

16.1 Disclaimer of Liability

idumhitum.lk is not liable for:

• Errors, omissions or inaccuracies in listings or other Content.
• Technical issues, interruptions, downtime or unavailability of the Website.
• Loss of data, corruption of data or delays in transmission.
• Misrepresentation, fraud or unlawful conduct by advertisers or other users.
• Damages arising from the use of or inability to use the Website.
• Any indirect, incidental, special, exemplary, punitive or consequential loss or damage, including loss of profits, business, goodwill, opportunity or data.

Users access and rely upon the Website and its Content entirely at their own risk and are solely responsible for independently verifying all property details, ownership, legal status, documents, approvals and any other information before entering into any transaction.

16.2 Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of idumhitum.lk, arising out of or in connection with the use of the Website or these Terms, whether in contract, tort (including negligence), statute or otherwise, shall not exceed the total amount of fees, if any, paid by the User to idumhitum.lk during the twelve (12) months immediately preceding the event giving rise to the claim. Where no fees have been paid by the User, idumhitum.lk shall have no monetary liability to the User to the fullest extent permitted by applicable law.

17. Indemnification

Users agree to indemnify idumhitum.lk, its owners, employees, and partners against any claims, losses, damages, or expenses arising from:

• Violations of these Terms
• Misuse of the platform
• Fraudulent or illegal activity
• Infringement of third-party rights

18. Modifications

idumhitum.lk may update these Terms at any time. Changes take effect immediately upon posting. Continued use of the Website constitutes acceptance of the updated Terms.

19. Governing Law

These Terms and your use of idumhitum.lk shall be governed by and interpreted in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute, claim or matter arising out of or relating to these Terms, the Website or the services provided through idumhitum.lk shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
